Final sale terms are governed by our Terms & Conditions for Used Equipment. Any quote request, inquiry, or pricing displayed on the website does not constitute a binding offer by SIGMA, and your submission of a quote request does not create a binding contract. A binding agreement for the sale of equipment will arise only when SIGMA issues a written order confirmation or executes a separate written agreement incorporating the Terms & Conditions for Used Equipment or other applicable sale terms.
SIGMA may correct any clerical, typographical, or computational errors in any quote, invoice, or other documentation, even after issuance, and may cancel or refuse orders based on erroneous pricing or availability information, subject to applicable law.
We make every effort to ensure the accuracy of information on our website, but we do not guarantee that listings, specifications, or pricing are free of errors or omissions. Some listings may be archived and provided for reference only. You acknowledge that equipment descriptions, specifications, photos, and availability are subject to change without notice and may differ from the actual equipment. These Terms are governed by the laws of Indiana, USA. Any disputes will be handled exclusively in Vanderburgh County, Indiana, courts.
You and SIGMA agree that any claim or dispute arising out of or relating to these Terms or your use of the Service (excluding claims relating to SIGMA’s intellectual property rights or the sale of equipment governed by separate terms) will be brought exclusively in the state or federal courts located in Vanderburgh County, Indiana, and you consent to the personal jurisdiction and venue of such courts.
To the fullest extent permitted by law, you and SIGMA agree to bring any claims against each other only in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You and SIGMA waive any right to a jury trial to the extent permitted by law.
You agree to indemnify, defend, and hold harmless SIGMA, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) any content or information you submit through the Service; (c) your violation of these Terms; or (d) your violation of any rights of a third party or any applicable law.
